GrowMe+ Terms of Use
These terms govern your access to and use of GrowMe+.
1. Acceptance and eligibility
These Terms form an agreement between you and Natives AI, the provider of GrowMe+. By accepting or using GrowMe+, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the app. A parent or legal guardian must supervise a minor's use and is responsible for that use where permitted by law.
2. General information only
GrowMe+ provides general educational and informational material. It is not a substitute for professional botanical, toxicological, medical, veterinary, nutritional, agricultural, legal, biosecurity, emergency, or other expert advice. Tohunga, Plant ID, Maramataka, weather, gardening, pest, disease, remedy, and seasonal guidance must not be treated as professional instructions or guarantees.
3. Identification and consumption risk
Do not rely on GrowMe+ to determine edibility, toxicity, dosage, treatment, harvest safety, or whether a substance is suitable for a person or animal. Do not consume unidentified or uncertain material. Check multiple authoritative local sources and a qualified expert in person. You are responsible for decisions to access, harvest, handle, prepare, consume, administer, or share anything.
4. AI and data limitations
AI, image recognition, community information, weather data, location data, lunar calculations, translations, and automated moderation can fail or produce inaccurate, outdated, incomplete, culturally inappropriate, or misleading results. Confidence labels are not proof of accuracy or safety. Never disregard an expert warning or delay professional help because of app content.
5. Kai Map and community content
Map locations and user submissions are not verified guarantees of identity, ownership, access permission, legality, availability, condition, hygiene, freedom from pesticides or contamination, or safety. Obtain landowner permission, obey local laws, tikanga, biosecurity rules, conservation restrictions, and food-safety requirements, and assess each location yourself. Never trespass or take food without permission.
6. Emergencies and poisoning
GrowMe+ is not an emergency service. If poisoning, an allergic reaction, breathing difficulty, severe illness, or another emergency may have occurred, stop using the app and contact local emergency services or your local poison centre immediately. In New Zealand call 111 for an emergency or 0800 POISON (0800 764 766) for the National Poisons Centre.
7. Accounts, trials, and subscriptions
You must provide accurate account information and protect your login. A selected monthly or annual plan begins after the advertised seven-day trial unless cancelled through the relevant app store before the trial ends. Pricing, renewal, cancellation, refunds, and taxes are also governed by the app store's terms and mandatory consumer law. Ending access does not immediately delete saved data; use the account-deletion controls to request deletion.
8. Your content and conduct
You retain ownership of content you submit and grant Natives AI a worldwide, non-exclusive, royalty-free licence to host, process, reproduce, adapt, moderate, and display it only as needed to operate, secure, and improve GrowMe+. You must have the necessary rights and permissions and must not submit unlawful, dangerous, deceptive, infringing, private, or abusive content. We may remove content or suspend access to protect users or the service.
9. Service availability and intellectual property
GrowMe+ and its original software, branding, and content are owned by Natives AI or its licensors. We may change, suspend, or discontinue features and cannot guarantee uninterrupted, secure, or error-free operation. Third-party services and content remain subject to their own terms.
10. Disclaimers
To the maximum extent permitted by law, GrowMe+ is provided "as is" and "as available", without warranties or guarantees of accuracy, safety, fitness for a particular purpose, availability, non-infringement, or results. Nothing in these Terms excludes any warranty, guarantee, remedy, or right that cannot lawfully be excluded, including applicable rights under the New Zealand Consumer Guarantees Act 1993.
11. Limitation of liability
To the maximum extent permitted by law, Natives AI and its personnel are not liable for indirect, incidental, special, consequential, exemplary, or punitive loss, loss of data or profits, or harm arising from reliance on an identification, recommendation, translation, map location, user submission, or third-party service. Where liability cannot be excluded, our aggregate liability is limited to the greater of NZD 100 or the amount you paid for GrowMe+ in the 12 months before the event giving rise to the claim. This limitation does not apply where prohibited by law.
12. Responsibility and indemnity
To the extent permitted by law, you are responsible for your use, your content, and your decisions. You agree to indemnify Natives AI against third-party claims, losses, and reasonable costs caused by your unlawful use, your content, trespass, infringement, or breach of these Terms. This does not require you to indemnify us for liability that the law does not permit us to transfer.
13. Governing law and international use
These Terms are governed by New Zealand law and disputes are subject to the non-exclusive jurisdiction of New Zealand courts. If you use GrowMe+ elsewhere, you must comply with local law. Mandatory protections in your country continue to apply where they cannot lawfully be excluded or limited.
14. Changes, severability, and contact
We may update these Terms and will request acceptance again when a material new version applies. If one provision is unenforceable, the remaining provisions continue. Questions, safety reports, or legal notices may be sent to george@nativesonscreen.co.nz.
